COPYRIGHT TRANSFER/AGREEMENT FORM OF FOOD SYSTEM FUNCTIONALITY
(FSF)
(To be turned in with manuscript to the Editor, FSF)
PART 1: GENERAL AGREEMENT
The undersigned, with the consent of all co-authors (if
any), hereby transfers all copyright interest in the above mentioned
manuscript (chapter, book, resecopyright interest in the above mentioned
manuscript (chapter, book, research article or any other type of publication),
and all published or unpublished version/s of the same, in any format (paper,
electronic, etc.), hereinafter termed "WORK", to Food System Functionality
(FSF) subject to items listed below. If the manuscript is not accepted
by FSF, withdrawn prior to or after acceptance by FSF, this transfer will
be nul and void:
A. The AUTHOR retain/s the right to revise, adapt, prepare derivative works, present orally, or distribute or transmit to not more than 25 colleagues, their own publication, provided that copyright credit is given to the source and FSF, that recipients are informed that they may nor further distribute or reproduce the WORK, and that all such use is only for the personal noncommercial benefit of the author/s and is consistent with any prior contractual arrangement between the undersigned and/or coauthors and their employer's.
B. Where a WORK is prepared as a "work made for hire" for an employer, the employer/s of the AUTHOR retain/s the right to revise, adapt, prepare derivative publications, reprint, reproduce, and distribute the work in print format, and to transmit it on an internal, secure network for use by its employees only, and additional rights under A, provided that all such use is for the promotion of its business enterprise and motion of its business enterprise and does not imply endorsement by FSF.
C. The editorial/review process of the FSF may involve external and/or internal review as decided by the Editor. Once the review process is over, acceptance is contingent upon the receipt, within designated time, of all required legal documents, i.e., copyright status, permission for use of copyrighted materials, etc., a final version (so certified by the AUTHOR) of the WORK (in MS WORD) in floppy or CD-R with all original figures and tables (hard copy and in floppy).
D. In order to publish the WORK, FSF reserves the right to assign all copyrights stemming from this assignment to a third party or publisher. However, all intellectual credits pertaining to authorship will remain solely that of the AUTHOR.
E. Acceptance of the WORK by FSF does not guarantee publication though efforts will be made by the FSF within practical, logistical, legal and financial limitations. A accepted WORK may be returned without publication if the third party or publisher (as in item D above) is unwilling to include the WORK in the publications, if it falls outside the intended theme of the book, or if it is no longer relevant to the intellectual pursuit of the FSF.
F. The AUTHOR and FSF have no financial obligation to each other related to the publication
of the WORK.
G. For publication prepared under U.S.
Government contract or by employees of a foreign government or its instrumentalities,
FSF recognizes that governments prior nonexclusive, royalty-free license
to publish, translate, reproduce, use, or dispose of the published forms
of the work, or allow others to do so for noncommercial government purposes.
A validated contract number is necessary.
